Driving Substitute Vehicles

On most days, the world is straightforward. We get out of bed, eat breakfast, gently roll the vehicle out on to the road and start driving. But every now and again, the routine is disrupted and then the small print in your insurance policy takes on a new significance. Now you will really find out what you bought. As an example, let’s travel over to North Carolina where a family owned several vehicles. The husband usually drove a Toyota Sequoia but, on the fateful morning, his wife told him there was a possible problem with the brakes and she was taking it in for service. He therefore set off for work in the Mitsubishi Montero. He was hit from the rear and the vehicle rolled over, landing him in hospital and six months of rehabilitation before he was able to return to work.

The driver at fault only carried the minimum liability coverage of $30,000 and had no assets – he was not worth suing. But the policy on the Sequoia issued by the Companion Property and Casualty Insurance Company, carried losses of up to $1 million under an uninsured and medical payments policy. There was a provision giving coverage if the insured was driving a “temporary substitute auto”. On the face of it, this seems to cover driving the Montero. His usual vehicle needed repairs. The Montero was a temporary substitute. But, as is always the case, the insurer refused to pay. For something that looks obvious, this has generated several years of litigation. Starting in January 2005, we have been through three levels of court, ending in the North Carolina Supreme Court which did not reach a decision, but sent it back down to the original court for a full hearing on the facts. So, after almost six years, we are back where we started and no further forward.

This is yet another of those horror stories showing that attorneys and the courts they work in can tie a case up in knots for years without ever reaching a final decision. What’s interesting about this particular story is the extent to which an innocent buyer of insurance can end up the victim in the system. Here’s a man who owns two vehicles and, in good faith, he buys a policy that not only says it covers him when driving the nominated vehicle, but also when he’s driving a temporary substitute. Anyone looking at such a policy would imagine he was covered against all reasonable situations in which a claim might arise. Indeed, our policy holder has, from the start, alleged the insurer made the sale and subsequently acted in an unfair and deceptive way.

This leads us to two conclusions. Everyone should take the time to read all the terms of the policies offered, whether as full-price or cheap car insurance and, if there is any doubt in your mind as to the extent of the coverage, always ask specific questions. Secondly, if what you were told before you buy is later denied, get a good attorney who is prepared to fight for your rights. Get cheap car insurance and make the insurer pay!

What is ABS?

ABS is an abbreviation for Anti-lock Braking System and allows for steering while maximizing braking. ABS was developed to reduce skidding and maintain steering control when brakes are used in an emergency situation. When used properly, an antilock braking system allows the driver to maintain directional stability and control over steering during emergency braking situations, particularly on wet and slippery road surfaces.

When was ABS introduced?

ABS was originally used in aerospace applications – specifically, to reduce wear and tear on aircraft tyres after landing. The first car (worldwide) to have ABS fitted as standard across the entire range was the Ford Granada Mk 3 (of 1985). BMW made the technology standard on all vehicles in 1986. Since it came into widespread use in production cars, ABS has made considerable progress. The technology is now much lighter and more efficient.

How does it work?

A typical ABS is composed of a central electronic unit, four speed sensors (one for each wheel), and two or more hydraulic valves on the brake circuit. When the system senses that any of the wheels are rotating considerably slower than the others (a condition that will bring it to lock) it moves the valves to decrease/increase the pressure on the braking circuit, effectively reducing/increasing the braking force on that wheel. This process is repeated continuously, causing a pulsing feel through the brake pedal.

Advantages of ABSIn effect, ABS is a mechanical way of cadence braking (or pumping the brakes). There are two advantages for the typical driver. One is that the ABS system is able to “pump” the brakes on and off much quicker than the driver’s leg, and the other is that it requires no skill or experience – the car does all of that for you.

Disadvantages of ABS

Unfortunately, safety experts have found that many drivers don’t benefit from ABS because the correct techniques for using them are almost the opposite of everything that most of us have been taught about emergency braking in cars. To gain any safety advantage from ABS, drivers must learn how to operate it correctly. ABS is designed to help the driver maintain control during emergency-braking by preventing the vehicle’s wheels from locking. This allows drivers to maintain steering control under heavy braking and to hit the brakes fully with less fear of skidding or loss of control. It does this by either preventing the wheels from locking, or if they do lock, by releasing and then reapplying the brakes once more.

In vehicles are not equipped with ABS, the driver must manually pump the brakes to prevent wheel lockup, maintain steering control and avoid hazards. In vehicles equipped with ABS, the driver’s foot remains firmly on the brake pedal, allowing the system to automatically pump the brakes. This makes ABS particularly useful for steering through skids, reducing both the likelihood and severity of collisions.

In Australia, The Royal Automatic Club of Victoria (RACV) was concerned about overseas research on ABS safety and commissioned Monash University Accident Research Centre (MUARC) to examine the Australian experience. MUARC analysed the crash records for a number of models that came equipped both with and without ABS, and compared their actual crash involvement.

The results were mixed, and rather disturbing. For multi-vehicle crashes, ABS-equipped vehicles were less likely to be involved (by about 18%) compared with the same model without ABS. However, for single-vehicle run-off-road crashes, e.g. leaving the road on a bend, ABS vehicles were over-involved by about 35% compared with the equivalent model without ABS. This increased involvement of ABS-equipped vehicles in run-off-road crashes is particularly concerning. Similar data is available for the US, which suggests that vehicles with ABS are 39% more likely to be involved in roll-over incidents.

Driving Lessons – Practical Revamp Required

Driving Lessons – Practical Revamp Required

Driving Lessons – Practical Revamp Required

Although the practical driving test is tough, it’s not tough enough and doesn’t fully, properly, cover the most tricky conditions new drivers face. The Theory Test doesn’t need to change. It’s been looked at and updated recently and from the feedback I get from my learners it helps them begin to notice hazards they would never have seen before. The latest update has seen the DSA stop publishing the exact questions, meaning you cannot simply memorise the questions and their answers. The most useful aspect of the test though is the Hazard Perception. I see a noticeable difference in learners’ awareness once they even start to practice this and they enjoy spotting dangers they wouldn’t have before.

The Practical Test is inadequate and failing new drivers. Although the emphasis on manoeuvres has diminished in recent times, which it needed to do, there is still not enough time to assess the candidate properly. All aspects of the optional extra – the Pass Plus Scheme – need to be made compulsory and included on the test. The popularity of the Pass Plus has vastly reduced and it wasn’t popular in the first place. After all, why would anyone want to spend at least another 120 on 6 more driving lessons when they don’t ‘have’ to, even if they really ‘need’ to, especially in these times of recession.

The Practical lasts for 30 – 40 minutes only, includes one manoeuvre, a 10 minute Independent Driving phase, potentially the emergency stop, and that’s it. It all depends where you live as to what types of roads you will drive on. On the very odd occasion I have instructed a Pass Plus for a new driver, having passed in a built-up area, their skills and understanding of driving country roads especially is frightening.

I personally think the practical should be split into 3 different tests, or ‘sessions’, where a candidate will need to pass each one before moving on to the next. The three main areas needing to be covered are town driving, country road driving, and motorways. Yes more time will be required, meaning more examiners so the waiting list for tests doesn’t get any worse than it already is. And with a lengthened test and more examiners it will prove more costly for learners – but how many lives will it save? Many, is my reckoning.

Phase 1 of the test should be the same as it is already for most areas. Town driving, emergency stop, independent driving and a manoeuvre. It should be conducted at a test centre that is sufficiently close to a town.

Phase 2 should see an emphasis mostly on country roads. This should include driving through country villages, single carriageway roads of varying speed limits including the national speed limit, and single track country lanes where the candidate will need to be on the lookout for oncoming vehicles. The test here is to make sure the candidate is able to drive at a speed suitable for the conditions and show the high state of awareness required for these roads. Remember, just because you’re on a 60mph road, this very rarely means it’s an appropriate speed.

Phase 3 will see the emphasis on dual carriageways and motorways. Again these would have to be conducted at a test centre suitably close to these types of road, of which there are already many. It would mean all learners will have to be aware of road laws they otherwise my not be. How often do you see tailgating, undertaking, and people driving too slowly in the outside lanes? And are they all aware what they are doing wrong?

These changes would hugely increase knowledge and understanding, see a sharp rise in general driving standards, decrease road rage and more importantly accidents and save tens if not hundreds of lives. If it also changes a few attitudes then we’re on the right track.
